WHAT IS A NONIMMIGRANT WAIVER?
A waiver is special permission from the Department of Homeland Security to enter the United States. Waivers must be approved in order to enter the U.S. You cannot enter the U.S. simply because a waiver application has been filed on your behalf.
Often, a foreign national is refused entry at a border or port-of-entry because they are deemed “inadmissible.” This might occur due to a past conviction or criminal charge, or because of a previous U.S. immigration violation. To avoid being stuck at the border or refused entry to the U.S., it is advisable to obtain a waiver to facilitate your U.S. entry, regardless of the purpose of your visit. Waivers are valid for a period up to 5 years and are available to both immigrant and nonimmigrant applicants.
